welcome to dermaskills products! the terms “we”, “us” and “our” refer to dermaskills products. dermaskills products operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “services”). dermaskills products is powered by shopify, which enables us to provide the services to you.

the below terms and conditions, together with any policies referenced herein (these “terms of service” or “terms”) describe your rights and responsibilities when you use the services.

when you place an order, you are making an offer to purchase. dermaskills products reserves the right to accept or decline your order for any reason at its discretion. your order is not accepted until dermaskills products confirms acceptance. we must receive and process your payment before your order is accepted. please review your order carefully before submitting, as dermaskills products may be unable to accommodate cancellation requests after an order is accepted. in the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e mail, billing address, and/or phone number provided at the time the order was made.

your purchases are subject to return or exchange solely in accordance with our refund policy [link].

you represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

section 4 - prices and billing

prices, discounts and promotions are subject to change without notice. the price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.

you represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

section 5 - shipping and delivery (uk only)

we ship only to addresses within the united kingdom. we are not liable for shipping and delivery delays. all delivery times are estimates only and are not guaranteed. we are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. once we transfer products to the carrier, title and risk of loss passes to you.

our services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by dermaskills products, its affiliates or licensors and are protected by uk and foreign patent, copyright and other intellectual property laws.

these terms permit you to use the services for your personal, non-commercial use only. you must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the services without our prior written consent. except as expressly provided herein, nothing in these terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of dermaskills products, shopify or any third party. unauthorized use of the services may be a violation of intellectual property laws. all rights not expressly granted herein are reserved by dermaskills products.

dermaskills products’s names, logos, product and service names, designs, and slogans are trademarks of dermaskills products or its affiliates or licensors. you must not use such trademarks without the prior written permission of dermaskills products. shopify’s name, logo, product and service names, designs and slogans are trademarks of shopify. all other names, logos, product and service names, designs, and slogans on the services are the trademarks of their respective owners.

section 7 - optional tools

you may be provided with access to customer tools offered by third parties as part of the services, which we neither monitor nor have any control nor input.

you acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. we shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

we may also, in the future, offer new features through the services (including the release of new tools and resources). such new features shall also be deemed part of the services and are subject to these terms of service.

we are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

dermaskills products is powered by shopify, which enables us to provide the services to you. however, any sales and purchases you make in our store are made directly with dermaskills products. by using the services, you acknowledge and agree that shopify is not responsible for any aspect of any sales between you and dermaskills products, including any injury, damage, or loss resulting from purchased products and services. you hereby expressly release shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with dermaskills products.

except as expressly stated by dermaskills products, the services and all products offered through the services are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement. we do not guarantee, represent or warrant that your use of the services will be uninterrupted, timely, secure or error-free. some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above disclaimer may not apply to you.

section 16 - limitation of liability

to the fullest extent provided by law, in no case shall dermaskills products, our partners, directors, officers, employees, affiliates, agents, contractors, service providers or licensors, or those of shopify and its affiliates, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the services or any products procured using the services, or for any other claim related in any way to your use of the services or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the services or any content (or product) posted, transmitted, or otherwise made available via the services, even if advised of their possibility.

you agree to indemnify, defend and hold harmless dermaskills products, shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these terms of service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the services.

we will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. we may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). you will cooperate in the defense of indemnified claims, including by providing relevant documents.

any ambiguities in the interpretation of these terms of service shall not be construed against the drafting party.

these terms of service and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of england and wales. you and dermaskills products consent to the exclusive jurisdiction of the courts of england and wales.

the headings used in this agreement are included for convenience only and will not limit or otherwise affect these terms.

you can review the most current version of the terms of service at any time on this page.

we reserve the right, in our sole discretion, to update, change, or replace any part of these terms of service by posting updates and changes to our website. it is your responsibility to check our website periodically for changes. we will notify you of any material changes to these terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. your continued use of or access to the services following the posting of any changes to these terms of service constitutes acceptance of those changes.

shipping information (products)

we hope you love your dermaskills products delivery – that’s why we’ve made shipping as easy as possible. all of our shipping is tracked – you will receive confirmation of your tracking number once your order has been packed. unless you have requested to collect the product from the clinic, in this case no shipping costs will be charged and you will be emailed to confirm your order is ready to collect. we ship only to the uk.

order tracking

we track every order. we’ll send you the tracking number of your order so that you can watch the moment your dermaskill product is shipped to the moment it’s in your hands! if you have any issue with your tracking information, email us at orders@dermaskill.co.uk and we will be happy to help.

when you make an order on dermaskills products, we will send you a confirmation email.

our team will then process the order within a day or so, we then hand it over to our nominated carriers. you will then receive a tracking number so you can see where your product is at any given time. we will arrange for the products to be delivered to the address for delivery indicated in your order. we will use reasonable endeavours to deliver products on or before the date for delivery set out in our order confirmation or, if no date is set out in our order confirmation, within 5 days of the date of our order confirmation. however, we cannot guarantee delivery by the relevant date. please note that if delivery is unsuccessful and your order is returned to us, we will charge a £5 administration fee to cover any costs incurred to us as a company; this will be deducted from your refund. the relevant courier will make reasonable attempts to ensure delivery; a calling card will be left. the courier will make no more than 3 attempts, after this it will be sent back to dermaskills products ltd and a refund will be processed minus the £5 administration charge. if products have been purchased without postage and package in error, £5 administration charge will be redeemed and the remaining amount will be refunded to client to order again with the correct postage and package.

  • please be aware that we are not responsible for information which has been entered incorrectly at checkout. if you have incorrectly entered your address and not contacted us to change this before the item is shipped, there will be an additional waiting period.

  • the only language in which we provide these terms of sale is english.
  • prices for products are liable to change at any time, but changes will not affect contracts that have come into force

limitations & exclusions of liability (products)

nothing in the terms of sale will:
(a) limit or exclude the liability of a party for death or personal injury resulting from negligence;
(b) limit or exclude the liability of a party for fraud or fraudulent misrepresentation by that party;
(c) limit or exclude any liability of a party under section 12, 13, 14 or 15 of the sale of goods act 1979 or part i of the consumer protection act 1987;
(d) limit any liability of a party in any way that is not permitted under applicable law; or
(e) exclude any liability of a party that may not be excluded under applicable law.

any statutory rights which you have as a consumer, which cannot be excluded or limited, will not be affected by the terms of sale. the limitations and exclusions of liability set out in this section [and elsewhere in the terms of sale]:

we will treat all your personal information that we collect in connection with your order in accordance with the terms of our privacy policy; use of our website will be subject to our website terms of use. contracts under these terms of sale may only be varied by an instrument in writing signed by both you and us. we may revise these terms of sale from time-to-time, but such revisions will not affect the terms of any contracts which we have entered into with you.

if any provision of these terms of sale is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect, and such invalid or unenforceable provisions or portion thereof will be deemed omitted.

no waiver of any provision of these terms of sale, whether by conduct or otherwise, in any one or more instances, will be deemed to be, or be construed as, a further or continuing waiver of that provision or any other provision of these terms of sale.

you may not assign charge, sub-contract or otherwise transfer any of your rights or obligations arising under these terms of sale. any attempt by you to do so will be null and void. we may assign, charge, sub-contract or otherwise transfer any of our rights or obligations arising under these terms of sale, at any time – providing such action does not serve to reduce the guarantees benefiting you under these terms of sale.

each contract under these terms of sale is made for the benefit of the parties to it and is not intended to benefit, or be enforceable by, any other person.

the right of the parties to terminate, rescind, or agree any amendment, variation, waiver or settlement under such contracts is not subject to the consent of any person who is not a party to the relevant contract. these terms of sale contain the entire agreement and understanding of the parties in relation to the purchase of products from our website, and supersede all previous agreements and understandings between the parties in relation to the purchase of products from our website; and each party acknowledges that no representations not expressly contained in these terms of sale have been made by or on behalf of the other party in relation to the purchase of products from our website.

these terms of sale will be governed by and construed in accordance with english law, and the courts of england and wales will have non-exclusive jurisdiction to adjudicate any dispute arising under or in relation to these terms of sale.

general terms and conditions

acceptance of terms and conditions

in using our services you are deemed to have read and agreed to all of the terms and conditions contained hereunder. all terms contained under the heading ‘general terms and conditions’ shall be read as though they are included also within the course terms and conditions.

definitions

the following definitions apply to these terms and conditions, privacy statement and disclaimer notice: delegate, customer, you and your means you, the person accessing our website and accepting these terms and conditions. we, us, ourselves means dermaskill academy ltd.

parties means both us and you unless the context requires otherwise.

terms and conditions means all terms and conditions including those relating to courses and the general terms and conditions.

services: courses and qualifications.

data protection and privacy

we respect your privacy and are committed to protecting your personal data. our privacy policy and cookie policy can be found here: [link] which will inform you as to how we look after your personal data when you visit our website (regardless of where you visit it from) and tell you about your privacy rights and how the law protects you.

we are registered under the data protection act 2018 and the uk general data protection regulation (uk gdpr). as such, any information concerning you and your records may be passed to third parties only as permitted by law.

we cannot provide our services effectively without collecting and processing information about you. we collect data about delegates for various administrative, academic and health and safety reasons. on filling out the application form and accepting these terms you will be deemed to have agreed to us processing the personal data you give in the application or booking form in accordance with the data protection act 2018/uk gdpr. the data will be used for any purpose connected with your studies, health and safety whilst on the training premises, or for any legitimate reason. however, we treat your records as confidential and we will not:

  • share your confidential records with any third party other than professional bodies such as the general medical council if legally required to do so;
  • sell, share or rent your personal information to any third party; or
  • use your email address for unsolicited mail.

you have the right to request sight of, and copies of any and all of your records by giving us reasonable notice of such a request. where appropriate we shall issue you with appropriate written information, handouts or copies of records as part of an agreed contract for the benefit of both parties. you are requested to retain copies of any materials issued to you in relation to the provision of our services.

general information

  • course overview: a brief description of the course content, objectives, and expected outcomes are on each course outline.
  • insurance during training: we hold public liability and training insurance for our activities. this covers you while you are on our premises and under the direct supervision of our trainers during your course.

prerequisites for each course

aesthetic treatments (non-medical):

  1. hifu (high-intensity focused ultrasound) – prerequisite: level 3 in beauty therapy.
  2. electrolysis hair removal – prerequisite: level 3 in beauty therapy.
  3. laser hair removal – prerequisite: level 3 in beauty therapy.
  4. hydrafacial – prerequisite: level 3 in beauty therapy or qualified medical staff.
  5. microneedling – prerequisite: level 3 in beauty therapy.
  6. laser hair removal and skin rejuvenation – prerequisite: level 3 beauty therapy certificate.

medical aesthetic treatments (prescription-only / invasive):

  1. botox (botulinum toxin) – foundation course
    prerequisite: doctors, dentists, surgeons, nurses, dental hygienists/therapists, odps, pharmacists, paramedics, physician associates. you must provide proof of your medical or health-related qualifications before booking.
  2. botox (botulinum toxin) – advanced course
    prerequisite: you must have completed the dermaskills academy botox foundation course (or an equivalent recognised foundation course) and have completed a minimum of 6 supervised treatments at foundation level. proof of completion and a treatment log may be required before booking.
  3. fillers (dermal fillers) – prerequisite: doctors, dentists, surgeons, nurses, dental hygienists/therapists, odps, pharmacists, paramedics, physician associates. you must provide proof of your medical or health-related qualifications before booking.
  4. prp and prf (skin and hair) – combined course
    • necessary prerequisites: you must be a nurse, dentist, doctor, physician associate, or pharmacist. phlebotomy qualification is required. you must provide proof of your medical or health-related qualifications before booking. drawing blood requires a medical background.
    • additionally, you must have completed microneedling training and phlebotomy training before attending this course. proof of completion may be required.
  5. prp and exosome (skin and hair) – combined course
    • necessary prerequisites: you must be a nurse, dentist, doctor, physician associate, or pharmacist. phlebotomy qualification is required. you must provide proof of your medical or health-related qualifications before booking. prp and exosomes are only for medics – drawing blood requires a medical background.
    • additionally, you must have completed microneedling training and phlebotomy training before attending this course. proof of completion may be required.
  6. Polynucleotide (Skin & Hair)

Must be a nurse, dentist, doctor, physician associate, or pharmacist. Phlebotomy qualification required. Must have completed microneedling training and phlebotomy training before attending. Proof of completion may be required. Polynucleotides are regenerative injectables – medical background essential

exam attempts – fees for 2nd and 3rd attempts

all courses require you to pass a multiple choice exam (mcq) and a practical exam.

  • first attempt: included in your course fee.
  • second attempt (theory or practical): free of charge for both.
  • third attempt:
    • theory (mcq) third attempt: £50
    • practical third attempt: £100

if you require a fourth or further attempt, these will be charged at the same rates as the third attempt. you must book re-sits within 6 months of the original course date; otherwise, you may need to retake the full course.

student dress code and hygiene

for all practical training sessions, you must comply with the following:

  • hair: must be tied back securely and kept away from your face.
  • nails: must be short, clean, and without extended nails or nail enhancements that could compromise hygiene or safety.
  • footwear: flat shoes or trainers are permitted. no heels (including block heels, wedges, or stilettos) are allowed due to health and safety requirements.
  • gloves and aprons: we will provide disposable gloves and aprons for use during practical sessions. you are required to wear them as instructed by your tutor.

failure to comply with the dress code may result in you being refused entry to the practical session, with no refund or transfer fee waiver.

enrollment & registration

enrollment process: please email training@dermaskills.co.uk. to register for training, you must complete the online registration form emailed to you. the form requires you to provide evidence of relevant qualifications and experience.

upon submission of the completed registration form and the necessary supporting documentation, you will receive an email confirming your registration.

the email confirmation will include important details about the training, including the scheduled dates, times, and any specific requirements you must meet in preparation for the training session.

it is your responsibility to ensure that the information provided is accurate and complete. failure to provide the required documentation may result in a delay or cancellation of your training session.

fees and payment terms:

the total cost for the training program is emailed to you, which includes all relevant materials, assessments, and certification, unless otherwise stated.

full payment is required by the date in the email, unless otherwise agreed upon. failure to make payment by the specified deadline may result in the postponement or cancellation of your training registration.

student responsibilities

  • attendance: you will be expected to turn up punctually for the course, as provided by your tutor. any medical conditions should be discussed prior to the course and noted on your booking form. you should be prepared to give and receive treatments throughout the course to complete and be deemed competent.
    punctuality is essential – all learners to arrive for 9.15am for a 9.30am start and training to finish at approximately 4.30pm. allow adequate time to travel to the training centre. lateness is very disruptive for other students and may mean you miss fundamental aspects of the training. you will be refused entry if you arrive late for training. there is a transfer fee of £50 per training date to reschedule your training if you arrive late. please do not break from the training unless instructed to do so by the tutor. a lunch break is provided along with short refreshment breaks throughout the day, timed as is appropriate for the course. taking excessive or unauthorised breaks may mean you miss vital training that impedes your success on the course. students are advised to remain in the centre during agreed breaks (please bring cold food). should you leave the centre and return late from break(s), you may be refused entry and be unable to complete your course.
  • use of mobile phones is prohibited during training and should be turned off outside of agreed breaks.
  • no use of e-cigarettes/vaporisers, smoking or chewing of gum within the training centre.
  • students must not consume or be under the influence of alcohol or drugs at any time during attendance of the training or assessment day(s). you may be asked to leave the centre where we have reason to suspect such influence, and the police may be contacted if appropriate.
  • some training course models will be provided for the purpose of education. this will be advised in your booking form.
  • named student booked training is non-transferable to an alternative student. please ensure the booking is made giving the correct name of the person attending the course at the time of making payment. amendments to this will be chargeable at £50 per course date/person, where possible for a change to be accommodated and a minimum of 48 hours’ notice prior to the course date is required, in writing.
  • minimum student age: we accept all students aged 18 years or over for our face to face training courses. please note most insurers will only provide public liability (beauty therapist) insurance for working with the general public to those aged 18 or over.
  • medical conditions or disabilities: please state any students with medical conditions or disabilities should notify the institution on the form provided and what accommodations (if any) will be made.

student responsibility for providing a model

  • provision of a model: for most courses, students are required to provide a model for the practical elements of the training. if, for any reason, a student is unable to serve as a model (due to medical conditions, personal preferences, or any other circumstances), it is their responsibility to arrange for a suitable model who meets the course's specific requirements.
  • if a student is unable or unwilling to be a model for their classmates, they have the option to bring a suitable model to the course. it is important to note that dermaskills training does not provide models for students, and it is the student’s responsibility to ensure their model meets the specific course requirements.
  • specific treatment areas cannot be guaranteed as this is based on clinical indications presented on the day.
  • model eligibility: the model provided by the student must be available for the full duration of the practical sessions and must adhere to any guidelines or restrictions set forth for the course. the model must also meet any health and safety standards as outlined by the training provider.
  • failure to provide a suitable model: if the student fails to bring a suitable model, this may affect their ability to fully participate in the practical components of the course. in such cases, the student may not be able to complete the practical requirements of the course, which could affect the overall completion of the training program.

cancellation / refunds policy

  • please note cancellation charges apply. upon booking, 50% of the course fee is immediately non-refundable. bookings which are cancelled less than 1 month prior to the course are 100% non-refundable.
  • we require at least 1 month’s written notice to make any changes to your course booking or training dates. we are not able to reschedule or move any training course bookings that fall within 1 month of the course date.
  • rebooking/transferring your course date: if we have to cancel any course due to an event beyond the control of such party including but not limited to any act of god, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, we will offer the opportunity to reschedule your training course booking to a later date. in such circumstances, any requests to cancel a course booking would be covered under our usual cancellation terms.
  • we reserve the right to amend or cancel any training date or location. should this be necessary our staff will contact delegates immediately and arrange an alternative date.
  • we reserve the right to cancel course bookings or withdraw delegates from the course that we feel to be disruptive, defamatory or impeding of our courses.
  • payment is required at the time of booking. we do not store credit card details nor do we share customer details with any 3rd parties.
  • please be aware that only 1 discount code can be used per booking.
  • a certificate of completion of the course will be issued upon completion.
  • medical reasons (with a valid medical certificate covering named student/training date).
  • compassionate reasons such as close family bereavement (proof of which may be required) for non-attendance.
  • if a course or practical session date is cancelled by dermaskills training, no refund is given however an alternative date will be offered.
  • we do not accept any liability for the cost of any travel expenses or hotel/accommodation costs incurred by delegates to attend our courses.

practical sessions

  • dermaskills reserves the right to determine class sizes and venues at short notice, or cancel a course due to insufficient delegates at 48 hours’ notice. alternative courses will be held if this occurs, no refund is given. delegates cannot choose which trainer they wish to have.
  • food will be provided by the company, please make us aware of any special dietary needs a week prior to the course so we can fulfil your requirements.
  • please be aware that any delegates arriving late to the course may not be able to participate in the course or certified.

photography

  • we ask delegates not to take any photographs or videos during any of our training courses. before and after photographs that are taken for the purposes of your training portfolio remain the property of dermaskills and are only for use as part of your training record. these images are not available for delegates to use in their own professional portfolios or on their social media/web pages.
  • dermaskills training may take photos on the training day for use on our website, social media pages and marketing activities. all delegates will be asked to opt-in when completing the course registration at the beginning of the day. if you do not wish to be included in any course photos, please notify the coordinator on the day and step away from any photographs being taken. in line with legislation, you have the right to change your mind at any time and request we remove any photograph with you in from our website or social media accounts. if you have any concerns or would like us to remove a photo of you, please contact training@dermaskills.co.uk.

course materials

  • provision of materials: all course manuals will be provided on the day of training.
  • copyright and usage: any restrictions on the use, reproduction, or distribution of course materials (e.g., lectures, recordings, or documents) are as set out in the intellectual property section below.

certification

  • certification requirements: on completion of the course all certificates will be emailed to you directly or given on the day.

health and safety

  • liability waiver: students and models will be required to sign a waiver acknowledging that the institution is not liable for accidents or injuries that occur during training sessions, to the extent permitted by law.

confidentiality and data protection

data collection, storage, and use

  • collection of personal information: in order to process your enrollment and provide the necessary training services, the institution will collect and store personal information, including but not limited to your name, contact details, payment information, and any other relevant data required for the administration of the course.
  • use of personal information: the personal information collected will be used solely for the purpose of processing your enrollment, providing the training, managing your participation, and communicating important course-related information. personal data may also be used for administrative purposes such as issuing certificates, confirming payments, or responding to queries. only the name and contact number will be provided to suppliers for purchasing goods, in compliance with gdpr regulations. by signing the training form and attending the training, you confirm your agreement to this.
  • data retention: the institution will retain your personal information on record for as long as necessary to fulfill the purposes outlined above, in accordance with applicable data protection laws and regulations. after this period, personal information will be securely deleted or anonymised, unless otherwise required for legal or regulatory purposes.
  • data protection: the institution is committed to protecting your personal information and will take reasonable steps to safeguard it in accordance with data protection laws, including the uk data protection act 2018 and the uk general data protection regulation (uk gdpr). your data will not be shared with third parties without your consent, except where required by law.

confidentiality

  • confidential information: both during and after the course, the institution may provide proprietary knowledge, materials, or information that is considered confidential. this may include training methods, course content, business plans, strategies, or other confidential information shared during the training.
  • non-disclosure of confidential information: students agree not to disclose, share, or use any confidential information obtained during the course for any purpose other than the purpose of the training, without the prior written consent of the institution. this obligation of confidentiality extends to all students, models, and other individuals involved in the training sessions.
  • student data confidentiality: any personal or sensitive data shared by students during the course, including performance, assessment, or feedback data, will be treated with the utmost confidentiality. such data will not be shared with third parties without the explicit consent of the student, except where required by law.
  • breach of confidentiality: any breach of this confidentiality clause may result in the immediate termination of the student’s participation in the course, and may lead to legal action depending on the severity of the breach.

communication

  • primary communication channels: communication between the students and the institution will primarily occur via email or phone. students are expected to provide accurate and up-to-date contact information to ensure effective communication.
  • timely responses: the institution strives to respond to all student inquiries within 72 hours of receipt. if a response cannot be provided within this time frame, students will be notified of the delay and given an estimated response time.
  • course announcements and important updates: all important updates, such as changes to the course schedule, updates to course materials, or other critical information, will be communicated to students via email. students are responsible for regularly checking their email inbox for such announcements and updates.
  • urgent inquiries: in case of urgent matters, students may contact the institution via phone, and the institution will make reasonable efforts to address urgent issues as quickly as possible during normal business hours.
  • student responsibility: students are responsible for ensuring that their contact details, particularly their email address and phone number, are kept current. the institution will not be held responsible for failure to communicate if contact details are incorrect or outdated.

disciplinary actions

  • grounds for disciplinary action: situations where a student may face disciplinary action (e.g., cheating, plagiarism, disruptive behavior, non-compliance with course rules, dress code violations).
  • disciplinary procedures: the process for addressing violations (e.g., verbal warnings, written notices, or expulsion).
  • appeals process: how students can appeal disciplinary actions if they feel unfairly treated.

disclaimers and limitations (training)

  • course availability: the institution reserves the right to cancel, postpone, or modify courses due to low enrollment or unforeseen circumstances.
  • course changes: any changes to the course content, instructors, or schedule will be communicated as soon as reasonably possible. our courses are taught to a high standard throughout. we do not train you nor can any therapist diagnose medical conditions and should not be treated as a substitute for medical care. contraindications and benefits are discussed as part of the course but are not intended to represent medical advice, nor be deemed as a treatment to cure or prevent disease.
  • all manuals have been checked and approved for accreditation. in the case of courses that we teach for other recognised training providers these will be accredited under the other recognised training providers.
  • dermaskills academy accept no liability for injury or loss to person or property, nor do we hold responsibility for damage caused by you to another person after you have received your training, to the fullest extent permitted by law.
  • the aesthetic industry is currently unregulated within the uk. like many authorised training providers, our curriculum has been assessed and approved by cosmetic indemnity providers who provide recognition & authorisation of indemnity. with this status being held, we cannot be held responsible if: the guidelines change; there are further requirements for future qualification which are not met by dermaskills training structure (except as set out in the change in law clause below).
  • all liability for damages arising out of or in connection with your use of our website is excluded to the fullest extent permitted by law. this includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or you have advised us of the possibility of such potential loss), damage caused to your computer, software, systems and programmes and the data thereon or any other direct or indirect, consequential and incidental damages.
  • any direct or indirect or consequential losses (including loss of profit, revenue, anticipated savings or wasted expenditure) other than when your booking cannot be fulfilled, following conclusion of a binding contract and in which case we shall be liable only for the fees paid for the booking.
  • we are not responsible for any delay or failure to comply with our obligations under these terms and conditions if such delay or failure arises from any cause which is beyond our reasonable control (this provision does not affect your statutory rights).
  • we provide the services to the best of our ability, however, we do not warrant that the service from the website will be uninterrupted, timely or error free.

change in law clause

  • you acknowledge that the aesthetic and medical aesthetics industry is subject to evolving laws, regulations, statutory guidance, and professional standards (each a “change in law”).
  • if, after you book a course, a change in law occurs that:
    (a) makes it illegal or impossible for us to provide the training as described; or
    (b) requires us to materially modify the training content, duration, delivery method, or prerequisites to remain compliant;
    then we may, at our sole discretion, do one of the following:
    (i) modify the training to comply with the change in law (with no additional cost to you); or
    (ii) cancel the training and refund any fees you have paid, less a reasonable administration fee (not exceeding 20% of the course fee) if we have already incurred significant costs in preparing for your course.
  • we will notify you of any such change in law and our proposed action as soon as reasonably practicable. if you do not agree to the modified training, you may cancel your booking and receive a full refund (or a pro-rata refund if the course has already started).
  • this clause does not exclude any liability that cannot be excluded by law, including for death or personal injury caused by our negligence.

insurance after completion and certification

12.1. during your training with us, you will be covered under our public liability and training insurance while you are on our premises and under the direct supervision of our trainers. this cover applies only to activities carried out as part of the training course.

12.2. after you have successfully completed the course and received your certificate from dermaskills academy, you are required to obtain your own:

  • (a) public liability insurance with a minimum coverage of £1 million; and
  • (b) professional indemnity insurance that specifically covers the treatments you have been trained to perform.

12.3. you must not offer or perform any treatments on paying clients, models, or members of the public (outside of your training sessions with us) until you have obtained the insurance set out in clause 12.2.

12.4. we may, upon request, provide evidence of your course completion to your chosen insurer. you are solely responsible for ensuring your insurance is valid and sufficient for the treatments you intend to offer.

12.5. we accept no liability for your failure to obtain or maintain appropriate insurance after you have completed your training with us.

intellectual property rights (training)

  • ownership of course content: the institution retains full ownership of all intellectual property rights, including but not limited to copyrights, trademarks, and patents, associated with the course content, materials, and any related resources provided during the training program. this includes all written, digital, and audiovisual materials, as well as any supplementary resources developed or distributed by the institution.
  • restrictions on use: students and delegates acknowledge that all course materials and resources are provided solely for personal use in connection with the course. reproduction, distribution, modification, or creation of derivative works from the course content or materials is strictly prohibited without the prior written consent of the institution.
  • no transfer of rights: nothing in this agreement shall be construed as a transfer of intellectual property rights. all rights to the course content and materials remain with the institution, and students do not acquire any ownership or commercial rights to the materials provided during the course.
  • access to materials: students are granted a non-transferable, non-exclusive license to use the course materials solely for the purpose of completing the training program. this license is limited to the duration of the course and does not extend beyond the course completion date, unless otherwise explicitly stated.
  • use of institution’s branding and trademarks: students are prohibited from using the institution's name, logo, or any other trademarks or branding materials for any commercial purposes, including but not limited to marketing, advertising, or promotional activities, without express prior written consent from the institution.

governing law and jurisdiction (worldwide training)

  • governing law: these terms and conditions shall be governed by and construed in accordance with the laws of england and wales.
  • dispute resolution: in the event of any dispute, claim, or disagreement arising out of or in connection with these terms and conditions, the parties agree to first attempt to resolve the matter through informal negotiation or mediation.
  • jurisdiction: if the dispute cannot be resolved through informal negotiation or mediation, the parties agree that any legal action or proceedings arising out of or in connection with these terms and conditions shall be exclusively brought before the courts of england and wales. the parties hereby submit to the exclusive jurisdiction of such courts.
  • international disputes: for students located outside the uk, the institution retains the right to initiate legal proceedings in the courts of england and wales, regardless of the parties' locations, unless otherwise mutually agreed in writing. by enrolling, you agree to accept service of process by email or any other means reasonably calculated to give notice.

acknowledgment and agreement

  • acknowledgment of terms and conditions: by enrolling in the course, students are required to acknowledge that they have read, understood, and agree to these terms and conditions in their entirety.
  • signing of acknowledgment form: prior to completing the enrollment process, students must sign an acknowledgment form confirming that they accept these terms and conditions. this form may be signed either electronically (via a digital signature or check-box confirmation on the enrollment platform) or physically (by signing a printed copy of the form).
  • failure to provide acknowledgment: enrollment will not be considered complete and access to the course will not be granted until the acknowledgment form has been signed and returned (either electronically or physically) by the student.
  • record of agreement: the signed acknowledgment form will be retained by the institution for the purpose of verifying the student’s agreement to these terms and conditions.
